1. Our commitment to protecting your privacy.

Your privacy is important to us. We've developed this Privacy Policy to address how IVY Classic Industries, Inc., a New York corporation, ("IVY Classic", "we", "us" or "our"), its subsidiaries and affiliates worldwide collect, use, disclose, transfer and store your personally identifiable information (PII), when visiting our website, www.ivyclassic.com (the "Site").

IVY Classic is committed to protecting your privacy. You may visit most of our Site without providing any personal information to us. But we need information in order to provide you services that you request or process an order. and this policy explains our data policies and practices.

We reserve the right in our sole discretion, to modify, update, add to, discontinue, remove, or otherwise change any portion of this Privacy Policy at any time and for any reason. When we amend this Privacy Policy, we will revise the "last updated" date located at the top of this Privacy Policy. If you provide information to us or access or use the Site in any way after this Privacy Policy has been changed, you will be deemed to have unconditionally consented and agreed to such changes. The most current version of this Privacy Policy will be available on the Site and will supersede all previous versions of this Privacy Policy.

2. We Will Not Sell Your Data.

IVY Classic does not and will not sell any data you submit to us. We will use it to provide you with a better user experience.

3. What information do we collect?

For visitors to our publicly available Site, we may collect information from you when you browse or register on our Site. When a user registers to become an IVY Classic customer or to place an order, we collect the registration information. The information collected includes:

  • Customer Contact Name
  • Customer Contact Job Title
  • Company Name (if applicable)
  • E-mail Address
  • User ID and Password
  • Billing, Shipping and Literature Address (if different)
  • Contact Numbers (phone, cell phone, email, fax)
  • Federal Tax ID and/or DUNS#

Credit card numbers and expirations date information is not stored by us. We may use stored customer data to serve as the basis to provide improved content and improve the quality or selection of special product offerings.

We also collect certain information about your session which does not identify individual users when you visit our Site, such as internet protocol (IP) addresses, browser type, internet service provider, referring/exit pages, operating system, date/time stamp and clickstream data. We also use cookies as described in Section 5 below. Please note that this online Privacy Policy applies only to information collected through our Site and not to information that may be collected offline.

4. What do we use web visitor's information for?

We collect personal data for legitimate business purposes, which may include:

  • To personalize your experience (your information helps us to better respond to your individual needs)

  • Use of Cookies. Cookies are bits of electronic information that may be transferred to a visitor's computer or mobile device to identify specific information about the visitor's use of the website, email or other electronic media. We use cookies, for example, to preserve the contents of your virtual shopping cart between visits. The Site uses a browser feature known as a cookie, which assigns a unique identification to your computer. Cookies are typically stored on your computer's hard drive and are used to help track clicks as you go through the pages within our Site. We may also use cookies to tell us whether you have previously visited the Site. We also use cookies which may be set by third-parties with whom we have entered into agreements which may enable us to obtain analytics information about the use of our Site. Other than as provided herein, we will not use shared local objects (commonly referred to as "Flash cookies") in a manner inconsistent with the purposes for which they were designed unless you are specifically notified that we intend to use them for a specific service. Flash cookies are cookies that are placed on your computer that are not removed through normal browser management tools.
  • Use of Web Beacons, Clear-GIFs, Pixel Tags and JavaScript. We may use "pixel tags" (also called "action pixels," "web beacons" or "clear gifs") and/or JavaScript plug-ins, placed on our Site and in our emails to you. Both pixel tags, which are small graphic images (typically that you cannot see), and JavaScript plug-ins, which is code on a website or in an email message, are used for such things as recording web pages and advertisements clicked-on by a user, or for tracking the performance of email marketing campaigns. These devices help us analyze our customers' online behavior and measure the effectiveness of our Site and our marketing. We also work with third party service providers that help us track, collect, and analyze this information. We may provide you with options to search for products and information on our Site and/or mobile app. If you enter information in a search query box, we may store that information and we may aggregate that information with other information we may have about the browser and/or IP address from which the search query originated.

6. How do we protect your information?

IVY Classic takes commercially reasonable and appropriate measures to secure your personal data. Our publicly available Site is hosted on a secure server. We use administrative, technical, and physical security measures to help protect your personal information. While we have taken commercially reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information. We cannot and do not ensure or warrant the security of any information you transmit to us and you do so at your own risk. We will never request your password, username, credit card information or other personal information through email.

7. Third-party links

Occasionally, at our discretion, we may include or offer third-party links. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites.

We may use third-party web analytics services on our Sites, such as those of Google Analytics. These service providers help us analyze how users use the Sites. The information collected for this purpose (including your IP address and other information collected by automated means) will be disclosed to or collected directly by these service providers. Both we and others (such as our service providers and advertising networks) may collect personal information about our visitors' online activities, over time and across third-party websites.

Our Site is not designed to respond to "do not track" signals from browsers.

8. Options Regarding Your Information

Emails and Communications

If you no longer wish to receive correspondence, emails, or other communications from us, you may opt-out by:

  • Noting your preferences at the time you register your account with the Site.
  • Logging into your account settings and updating your preferences.

If you no longer wish to receive correspondence, emails, or other communications from third parties, you are responsible for contacting the third party directly.

9. Security Policy

All your personal information is securely transmitted to our Web site using an SSL (Secure Socket Layer) encryption key from GeoTrust.

We have implemented policies, rules and technical measures to protect the personal information we have gathered against:

  • Unauthorized access
  • Unwanted disclosure or use by third parties
  • Unauthorized modifications
  • Destruction or loss of information

All credit card information is encrypted when the order is processed. We do not keep the credit card numbers in our servers. We use secure servers protected by the strongest firewalls currently available on the market. Physical access to these servers is limited and controlled.

All employees that have access to or that are involved in processing your personal information are bound by a confidentiality clause.

10. Information for California Residents

If you are a consumer who resides in the State of California, then you are afforded specific privacy rights under the California Consumer Privacy Act of 2018, Cal. Civ. Code §§ 1798.100-1798.199 (the "CCPA"). 11. Do we disclose any information to outside parties?

We do not sell, trade, or otherwise transfer information obtained through our Site to outside parties, other than third parties who may assist us with operating our Site, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is necessary to comply with the law, enforce our Site policies, or protect our or other's rights, property, or safety, or share personal information as necessary to other corporate entities as part of a business transition such as a merger, acquisition, or sale of assets.
 
However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. Because we value your privacy, we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We will not distribute your personal information to outside parties without your consent.

12. Collection of Personal Information from Children

We do not collect any information from anyone under 13 years of age. Our Site and services are all directed to people who are at least 18 years old or older. If you are under the age of 13, you should not register with, order or purchase from, or provide information to or from, us. If we become aware that a user of our Site is under the age of 13 and has provided an online registration or other PII without prior verifiable parental consent, we will take all commercially reasonable steps to delete such information from our files and not to use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law). If you have knowledge or become aware that a child under the age of 13 has submitted PII to us, please contact us and we will remove that child's PII from our files. If you are under the age of 18, you should use the Site only with the involvement of a parent or legal guardian and should not submit any PII to us.

13. Changes to our Privacy Policy

IVY Classic conducts an annual self-assessment in order to verify that this Privacy Policy is published and implemented within the Company and that it complies with applicable law. If we decide to change our Privacy Policy, we will post those changes on this page, and/or update the Privacy Policy modification date below.
